Prosecutors dropped all prostitution-related charges against New England Patriots owner Robert Kraft.

“It’s not a lack of will to drop the charges,” said State Attorney Dave Aronberg during a virtual news conference on Thursday afternoon regarding the investigation into the Orchids of Asia Day Spa in Jupiter.

“Although there was probable cause to make an arrest, the evidence cannot prove all legally required elements of the crime alleged and is insufficient to support a criminal prosecution,” wrote Aronberg in the court filing.

Kraft faced two counts of solicitation of another to commit prostitution. In late 2018 and early 2019 Jupiter Police had the spa under surveillance and secretly recorded Kraft and two dozen other individuals as part of a criminal investigation into possible human trafficking.

“The Jupiter Police Department did the right thing in pursuing the investigation and I stand behind the decision to file the cases,” said Aronberg. “The Orchids of Asia Day Spa was a notorious brothel in a family shopping center, right next to a game room that attracted children. Rich guys from a local country club lined up to receive sex acts throughout the day until the place closed around midnight. Although we cannot prove human trafficking behind a reasonable doubt, there was evidence of human trafficking in the overall investigation.”

Police said the defendants paid for sex acts at the spa. According to the police report, Kraft entered the spa on the same day the Patriots played the Kansas City Chiefs for the AFC championship.

Aronberg said Thursday that none of the 25 defendants faced any charges related to human trafficking, or knew of the signs of human trafficking at the parlor.

Kraft challenged the use of the video. A court ruled police violated his Fourth Amendment rights and barred the use of the videos at trial. Kraft now wants those videos destroyed.

Aronberg said Thursday the cases against the other defendants in the case are also dropped. Charges against the owner and manager remain.
